Welcome to swiftsoftware.net (the "Site"), operated by SwiftSoftware ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Site and of the software products published by SwiftSoftware (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
The Services include, without limitation, FunnelSwift, WorkflowSwift, CoreSwift CRM, ADASwift, IncentiveSwift, and MissedCall Respondr. Each product may publish its own product-specific terms; where a product-specific term conflicts with these Terms for that product, the product-specific term governs that product.
You must be at least 18 years old. You must provide accurate, complete information during registration and keep your account details up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
Some Services are offered on free and paid subscription plans. Paid subscriptions are billed in advance on a recurring basis and, unless cancelled before the renewal date, renew automatically. Except where required by applicable law, payments are non-refundable. We may modify plan pricing with advance notice.
You agree to use the Services only for lawful purposes. You shall not: use the Services to build or transmit malicious code, phishing pages, spam, or unlawful campaigns; reverse-engineer the Services or attempt to extract their source code; attempt to bypass rate limits or security mechanisms; or host content that violates third-party intellectual-property or privacy rights.
The Services and their underlying software remain the exclusive property of SwiftSoftware. You retain ownership of all content and data you upload or generate through the Services ("Customer Data"). You grant SwiftSoftware a worldwide, non-exclusive licence to host, display, and transmit your Customer Data solely as necessary to provide the Services.
We work to keep the Services available and secure, but we do not warrant uninterrupted or error-free operation. We may suspend or restrict the Services for maintenance, security, or legal reasons.
You may cancel your subscription or delete your account at any time. We reserve the right to suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or where required by law.
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. SwiftSoftware shall not be liable for indirect, incidental, or consequential damages. SwiftSoftware's total aggregate liability shall not exceed the amount paid by you for the applicable Service in the twelve (12) months preceding the claim (or $100 if on a free plan).
